Terms of Service & User Agreement.

Effective Date: September 2026. Please read these Terms of Service carefully before accessing or using Doofer, operated by Doofer. By accessing our scanner or reading our guides, you agree to be bound by these terms.

1. Educational & Informational Service Only

Doofer is provided strictly for recreational, educational, and general horticultural informational purposes. The service delivers automated species classifications, computer-vision health diagnostics, and botanical reference content. Because plant morphology varies widely and digital image quality can be compromised, automated results may be inaccurate, incomplete, or delayed.

2. Critical Botanical, Medical & Toxicology Disclaimer

You explicitly acknowledge and agree that:

  • No Reliance for Ingestion or Foraging: You will never consume, harvest, cook, chew, or ingest any wild or domestic plant, mushroom, berry, or seed based on Doofer results or articles.
  • No Medical or Veterinary Advice: Doofer does not provide clinical healthcare, medical toxicology, or veterinary emergency services. See our full Plant safety disclaimer for emergency poison contact directories.
  • Personal Responsibility: You assume 100% legal responsibility for confirming the identity of any unfamiliar plant with a qualified local professional (e.g. certified nurseryman, university extension agent, or arborist) before handling or exposing pets or children.

3. Image Uploads & Intellectual Property Rights

When you capture or upload a photograph to Doofer:

  • You represent and warrant that you own the photograph or have obtained all necessary licenses to upload and analyze it.
  • You retain all copyright and proprietary ownership in your original photographs.
  • You grant Doofer and our machine learning provider (Kindwise) a non-exclusive, worldwide, royalty-free license to process, resize, and transmit the image solely for the technical execution of the plant identification query.
  • Original Doofer materials belong to Doofer. Third-party libraries, images, reference content, and trademarks remain subject to their owners’ rights and applicable licenses.

4. Prohibited Conduct & Abuse Prevention

You agree not to:

  • Use automated bots, scrapers, spiders, or crawlers to query our identification endpoints or scrape plant guides at scale.
  • Circumvent, disable, or tamper with security-related features, rate limiters, or authentication mechanisms.
  • Upload any image containing obscene, sexually explicit, defamatory, harassing, or malicious content.
  • Reverse engineer, decompile, or attempt to extract source code or underlying proprietary APIs.

5. Disclaimer of Warranties & Limitation of Liability

DOOFER IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, BOTANICAL ACCURACY, OR NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DOOFER, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT; (II) PERSONAL INJURY OR PROPERTY DAMAGE RESULTING FROM YOUR ACCESS TO OR USE OF THE SERVICE; OR (III) EXPOSURE TO OR INGESTION OF TOXIC BOTANICAL SPECIMENS.

6. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with standard commercial and consumer principles without regard to conflict of law rules. Any dispute arising under these terms shall be resolved exclusively by the competent courts having jurisdiction.

7. Third-Party Advertising & Commercial Content

Doofer may display third-party advertisements through Google AdSense when advertising is available and optional services are enabled.

Doofer does not endorse, warrant, or assume any liability for third-party products, services, or claims displayed in advertisements.

Clicking on ads opens third-party websites governed by their own terms and privacy policies.

CRITICAL: You agree not to click on advertisements repeatedly, use automated tools to generate ad clicks or impressions, or encourage others to click on ads for any purpose other than genuine interest in the advertised content. Fraudulent ad interaction violates our terms and Google's Invalid Traffic policies.

8. AI-Powered Conversational Assistance

Doofer offers an AI-powered conversational feature ("Ask about this plant") powered by third-party large language models via the Kindwise API.

AI-generated responses may contain inaccuracies, outdated information, or botanical hallucinations.

Conversational AI outputs do not constitute professional horticultural, medical, or veterinary advice.

We reiterate that it is your responsibility to independently verify all information provided by the AI.

9. Eligibility & Age Restriction

By using Doofer, you represent that you are at least 13 years of age.

Users under 13 must not submit photographs, use the conversational AI, or provide personal information.

10. Modifications, General Terms & Contact

Severability: If any provision of these Terms is held unenforceable, the remaining provisions shall remain in full force and effect.

Entire Agreement: These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and Doofer regarding Doofer.

No Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

Termination: We reserve the right to restrict or terminate your access to Doofer at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
